02 / Defense roadmap

What we do when the government decides.

When an administrative act harms your company, time is critical: the deadlines to challenge it are short. This is the path we follow with you.

  1. 01

    Review of the act

We analyze the decision, how it was served, its legal reasoning and the deadlines that start running from that moment.

  2. 02

    Strategy

We determine whether to appeal through administrative channels, go straight to the courts or pursue another solution.

  3. 03

    Administrative appeals

We file the appeal or, where applicable, the extraordinary petition for review, together with the supporting evidence.

  4. 04

    Protective measures

We request a stay of the act when its enforcement could cause serious harm to the company.

  5. 05

    Administrative lawsuit

We take the case to the Administrative Disputes Court so that a judge can review the legality of the decision.

  6. 06

    Enforcement

We oversee compliance with the judgment, including any payments and interest owed by the agency.

08 / Frequently asked questions

What clients often ask us.

General answers to common questions. Every company is different: write to us so we can review your situation.

01

What can I do if a public agency issues a decision against my company?

You can challenge it through administrative channels, using the appeals provided for in the Organic Administrative Code, or go to court. The deadlines are short, so the decision should be reviewed as soon as it is served.

02

Do I have to exhaust administrative remedies before filing a lawsuit?

As a general rule, no: the company can go directly to the Administrative Disputes Court. Choosing between an administrative appeal and litigation is a strategic decision we analyze case by case.

03

What is administrative litigation?

It is the court proceeding in which a tribunal reviews the legality of an act, contract or action of the public administration and, where appropriate, sets it aside or orders redress for the rights affected.

04

What should I do if I receive an enforced collection notice?

Immediately review the title being enforced and the deadlines. There are defenses and objections that can be raised, and in some cases it is possible to request that the attachments be lifted.

05

Can you help me if the contracting agency does not pay me or imposes penalties?

Yes. We analyze the contract and the agency's actions, file the administrative claims and, if necessary, take the case to court or arbitration, working with our public procurement practice.
