What clients often ask us.
General answers to common questions. Every company is different: write to us so we can review your situation.
01What should I do if I receive an information request or a tax assessment (glosa) from the SRI?
Check the deadlines right away and do not respond without a strategy. The information you provide at this stage can shape the outcome of the entire dispute.
02Can I challenge an SRI tax assessment?
Yes. You can file an administrative claim with the SRI itself or go directly to the tax courts, within the deadlines set by law.
03Can I recover taxes I overpaid?
Yes. The law allows you to request a refund of undue or excess payments and, in certain cases, of VAT, for example for exporters. We review your case and handle the request.
04When does a tax dispute become a criminal matter?
When there are signs of tax fraud (defraudación tributaria). In those cases, we coordinate the tax defense with our criminal law practice from the outset.
05What is tax planning?
It is the advance analysis of a company's operations and structure so that it pays the taxes it owes, while legitimately taking advantage of the benefits the law allows.
