Using artificial intelligence and forensic analysis, we review imports and exports to identify suspicious shipments.

    Suspension request

We request the suspension of the customs operation on goods that would use your brand without authorization.

  3. 03

    Confirmation

The intellectual property authority must confirm the measure within a maximum of three days.

  4. 04

    Right holder's actions

Once the measure is confirmed, we bring the appropriate legal actions through criminal, administrative or civil channels.

Defense of a detention of goods

A foreign trade operator brought a claim against Ecuador before the Andean Community over the detention of goods unfit for human consumption. Our defense argued that the measures were justified because the products were sensitive and high-risk, and the General Secretariat of the Andean Community ruled along those lines.

11 / Frequently asked questions

What clients often ask us.

General answers to common questions. Every company is different: write to us so we can review your situation.

01

What is a border measure?

It is a mechanism that allows a customs operation to be suspended when the goods are suspected of infringing intellectual property rights. The intellectual property authority must confirm it within a maximum of three days, after which the right holder brings legal action.

02

Do I need a registered trademark to take action?

For most actions, yes: registration with SENADI (Ecuador's IP office) is what proves your right. If you do not have it yet, our intellectual property practice can guide you through registration.

03

What should I do if I find counterfeit products bearing my brand?

Keep photos, invoices, addresses or links where you found them, without confronting the seller. With that information, we assess the most appropriate route: criminal, administrative, customs or civil.

04

Can you remove online listings selling counterfeits?

We identify and contact the infringers and manage the takedown of the listings. We have achieved a 72.4% success rate in voluntary takedowns, although each case depends on the platform and the infringer.

05

Is selling counterfeit products a crime in Ecuador?

The Comprehensive Organic Criminal Code (COIP) punishes trademark counterfeiting and piracy on a commercial scale. There are also administrative actions before SENADI and civil actions to claim damages.
