09 / Frequently asked questions

What clients often ask us.

General answers to common questions. Every company is different: write to us so we can review your situation.

01

When should you move from pre-litigation to judicial collection?

When the debtor does not respond, breaches agreements, or there is a risk they will dispose of their assets. We assess each loan to decide the right moment and keep it from losing value.

02

What documents do I need to start collection?

The contract or instrument evidencing the debt (promissory note, bill of exchange, check, invoice or loan agreement), the collateral, account statements and communications with the debtor. With these, we define the most efficient route.

03

What if I don't know where the debtor is or whether they have assets?

With Fextor, we conduct investigations to locate addresses and assets. That information allows the debtor to be served and measures to be requested against their assets. If the case involves fraud or hidden assets, we coordinate with our asset recovery practice.

04

Can mediation be used to collect a debt?

Yes. An agreement reached in mediation and recorded in the corresponding mediation record has the effect of a court judgment, which gives the creditor greater certainty if the debtor defaults. Learn more about mediation and arbitration.

05

How are debtors and their data treated?

We conduct collections respectfully and in accordance with applicable regulations, including personal data protection rules. Proper collection practices also protect your institution's reputation.
